Course content

This webinar will look at the practical problems of faced by attorneys, deputies and solicitors advising them around issues of capacity. It will examine the meaning of capacity being a “decision specific” test, when there is a duty to test a client’s capacity and how decisions can be made about whether a person has capacity for a particular decision. It will explore what best interest’s decisions a lawyer or attorney is entitled to make for a client who does not have capacity and what decisions should be referred to the Court of Protection.

About the speaker

David Lock QC is a barrister at Landmark Chambers. He is hugely experienced in mental capacity work and is rated in the top band of leading counsel for Court of Protection cases.
